First-time DWI/DUI Offenses

In Texas, a DWI charge aka DUI is a criminal offense that occurs when a person operates a motor vehicle while under the influence of alcohol, drugs, or any other intoxicating substance. The legal limit for blood alcohol concentration (BAC) in Texas is 0.08 percent.

1st DWI/DUI offense

  • a fine of up to $2,000

  • up to 180 days in jail

  • payment of court costs (can be hundreds of dollars),

  • license suspension for 3 to 6 months

  • CDL mandatory suspension for 1 year

  • donations to nonprofits

  • mandatory attendance in an alcohol education program, and

  • can result in a conviction on your record that cannot be deleted.

2nd DWI/DUI offense

In Texas, a second DWI aka second DUI offense is a more serious offense than a first-time DWI offense, and the penalties can be much harsher. The following are some of the penalties that may be imposed for a second DWI offense in Texas:

  • a fine up to $4,000

  • 3-day mandatory jail sentence even if you get probation

  • Up to 2 years’ probation

  • Interlock alcohol device or mobile alcohol device for a least half the time of probation and up to 2 years’ probation

  • License suspension for 2 years

  • Conviction of first-time DWI could possibly be used in jury trial of the 2nd DWI/DUI, and

  • can result in a conviction on your record that cannot be deleted

3rd or more DWI/DUI offense

In Texas, a third DWI offense is a felony offense and carries harsher penalties than a first or second offense. The following are some of the penalties that may be imposed for a third DWI offense in Texas:

  • a fine of up to $2,000

  • up to 180 days in jail

  • payment of court costs (can be hundreds of dollars),

  • license suspension for 3 to 6 months

  • CDL mandatory suspension for 1 year

  • donations to nonprofits

  • mandatory attendance in an alcohol education program, and

  • can result in a conviction on your record that cannot be deleted.
